    Know Your Rights: What to Do — and Not Do — During an Arrest in Texas

    An arrest is frightening and disorienting, and in those first moments it is easy to make decisions that hurt your case later. The good news is that the Constitution gives you powerful protections — but only if you understand them and use them. Knowing your rights ahead of time is the best way to protect yourself if you are ever stopped, questioned, or arrested in Texas.

    You Have the Right to Remain Silent

    The Fifth Amendment protects you from being forced to incriminate yourself. This is one of your most important rights. Beyond providing basic identifying information when lawfully required, you are not obligated to explain, justify, or discuss your conduct with police. Many people believe they can talk their way out of trouble; far more often, they talk their way into it. A calm, respectful statement that you wish to remain silent and want a lawyer is almost always the wisest response. Importantly, you should say so out loud and clearly — silence alone is not always treated the same as invoking the right.

    You Have the Right to an Attorney

    The Sixth Amendment guarantees your right to counsel. Once you ask for a lawyer, officers are generally required to stop questioning you. Ask for an attorney early, state it plainly, and then stop talking about the case — even casual conversation in a patrol car or holding cell can be used against you. If you cannot afford an attorney, one can be appointed, but you should still assert the right immediately.

    You Can Decline Consent to a Search

    The Fourth Amendment protects against unreasonable searches and seizures. In many situations, police need a warrant or a recognized legal exception to search your home, vehicle, or belongings. If an officer asks for your consent to search, you are allowed to decline politely. Saying “I do not consent to a search” does not make you guilty of anything — it simply preserves your rights and may matter a great deal if the legality of a search is later challenged. Note that officers may still search under certain circumstances without consent; declining consent does not mean physically interfering.

    What You Should Not Do

    In the stress of the moment, certain reactions consistently make things worse:

    • Do not resist or run. Even if you believe the arrest is wrong, resisting can lead to additional charges and injury. The place to challenge an arrest is in court, not on the street.
    • Do not lie or provide false documents. This can create new offenses on top of the original matter.
    • Do not consent to searches or interviews in the hope of seeming cooperative. Cooperation does not require giving up your rights.
    • Do not discuss your case with anyone but your attorney — not officers, not cellmates, and not over recorded jail phone lines.

    Stay Calm and Be Respectful

    Asserting your rights and being respectful are not in conflict. Keep your hands visible, avoid sudden movements, address officers calmly, and clearly state that you are choosing to remain silent and want a lawyer. A composed demeanor protects your safety and avoids handing the prosecution unnecessary ammunition.

    What Happens After an Arrest

    Following an arrest, you will typically be booked, and the question of release on bond will arise. Early involvement of a defense attorney can help at these initial stages — addressing bond, protecting your rights, and beginning to examine how the stop, search, or arrest was conducted. Procedural and constitutional issues identified early can become central to the defense.
